The CNMC’s Guide on Compliance Programmes in relation to antitrust laws builds on the CNMC application of compliance considerations in previous Decisions, as well as on the experience of other Competition Authorities and general compliance instruments, incorporating the best practices. The main drive of the CNMC with its Guidelines is to promote the implementation of antitrust issues in compliance policies within the Spanish companies and entrepreneurs. It is believed that in-house compliance programmes should prevent careless infringements, deter future ones and allow early detection within the company of existing antitrust wrongs. The incentives envisaged may provide leverage to those responsible of legal and compliance issues in their working structures, helping to disseminate a true and comprehensive antitrust culture in Spain.
