The Competition Law Global Governance Dilemma And The EU-China Relationship
Click here to read the full article onlineThis article reviews the wide range of mechanisms to deal with the increasing number of extraterritoriality issues and multijurisdictional problems brought by an ever-larger number of Competition law regimes. Scholars and practitioners have traditionally put forward an array of different approaches to ensure the effectiveness of each domestic jurisdiction but without neglecting the challenges of a globalized economy. In order to strike that balance, this article weighs the main features of hard-harmonization measures against those of soft-harmonization in favor of the adoption of the latter. Additionally, the article focuses on the adoption of the Chinese legal framework on Competition law and how European Union cooperation contributed to shaping and developing its Antimonopoly Law through cooperation under the scope of Global Governance.
